Waiver of Liability, Assumption of Risk and Hold Harmless Agreement

PLEASE READ THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND HOLD HARMLESS AGREEMENT (“WAIVER”) CAREFULLY BEFORE PARTICIPATING. BY ATTENDING ANY FOOTBREAKS COMMUNITY MEETUP, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

  1. Assumption of Risk:
    I understand that participation in outdoor community walking meetups organized by Footbreaks involves inherent risks, which may result in injury, illness, or death. These risks include, but are not limited to:

    • Slips, trips, and falls on uneven or wet surfaces.

    • Injuries due to physical exertion or overexertion (such as sprains, heat exhaustion, dehydration, or heart attack).

    • Exposure to weather elements such as extreme heat, sun, rain, or wind.

    • Encounters with animals, insects, or hazards such as uneven terrain, road crossings, or traffic.

    • The negligence of other participants, third parties, or Footbreaks representatives.

    • Accidents occurring in locations without immediate access to medical assistance.

  1. I acknowledge that I am voluntarily participating in these activities and assume full responsibility for all risks, known or unknown, associated with my participation.

  2. Health and Fitness:
    I certify that I am in good physical condition and capable of participating in the walk. I understand it is my responsibility to assess my own health and fitness for the activity and to bring appropriate personal items such as water, sunscreen, and protective clothing. I agree to monitor my own physical condition during the event and notify the organizer immediately if I need assistance.

  3. Behavior: By participating in a Footbreaks community meetup, I agree that my behavior shall be in accordance with the Footbreaks Community Commitment. Failure to act in this accordance may result in being asked to leave the meetup and banned from future meetups and the community, in Footbreaks’ sole discretion. 

  4. Medical Disclaimer: I understand that Footbreaks and its representatives are not medical professionals and do not provide medical advice, diagnosis, or treatment. Any recommendations or information shared during Footbreaks meet ups are for general informational purposes only and should not be considered medical advice. Participants are encouraged to consult with a licensed medical professional before engaging in any physical activity, particularly if they have pre-existing medical conditions or concerns about their health.

  5. Release of Liability and Indemnification:
    To the fullest extent permitted by law, I, on behalf of myself, my heirs, and legal representatives, hereby agree to release, indemnify, defend, waive, discharge, and hold harmless Footbreaks and its owners, employees, volunteers, and representatives from and against any and all liability, damages, losses, claims, demands, or causes of action (“Claims”) arising out of my participation in the community meetup, including without limitation the negligence of Footbreaks or any of its owners, employees, volunteers, and representatives, or arising out of my own actions or conduct. 

  6. Medical Treatment and Emergency Services:
    I understand that Footbreaks does not provide medical insurance or coverage for participants. In the event of an emergency, I authorize Footbreaks or its representatives to secure emergency medical care on my behalf. I agree to be responsible for any medical costs incurred as a result of my participation.

  7. Photographic/ Video Likeness:
    I grant Footbreaks a limited, royalty-free, revocable license to use photographs or videos taken during the meetup for promotional purposes only. If I do not wish to appear in promotional materials, I agree to notify the organizer before the event.

  8. Acknowledgment of Understanding:
    By participating in the community walking meetup, I represent and warrant to Footbreaks that I have carefully read, and fully understand and agree with, the terms of this legally binding Waiver. I voluntarily accept and assume all risks.
